1. Agreement to These Terms

These terms form a binding agreement between you and DKWeston LLC. They apply when you browse this website, submit the contact form, call the desk, reserve a signing table, collect a key tag, attend a move-out walk, rent a storage unit or accept a parking stall. They also apply when an owner engages us to prepare documents or to design a small system for a rental back office.

Where a separate written agreement or lease has been signed for a specific property, that document governs the terms of the tenancy. These terms continue to govern the desk services that we provide around that tenancy, unless the written agreement expressly replaces them.

You confirm that you have read the privacy practices described in our Privacy Policy before you send personal information to the desk.

2. Definitions

In these terms, the words below have the meanings given here. The definitions apply whether the words appear in singular or plural form.

  • Company means DKWeston LLC, including the desk staff and the developer known as DKWeston who maintains the desk systems.
  • Website means the pages served at dkweston.lol and any subpage that links to these terms.
  • Services means the rental desk work, key handling, walk sheets, deposit cycles, storage rentals, stall assignments and systems design work described on this site.
  • Owner means a person or entity that owns or manages a property and engages the Company for a service.
  • Tenant means a person who signs a lease, receives a key tag or occupies a unit covered by a service.
  • Unit File means the combined record that holds the lease, key receipt, walk sheet, deposit notes and related correspondence for a property or unit.
  • Desk Appointment means a reserved time at the Spanish Fork porch for a signing, walk, key issue or consultation.

3. Eligibility and Authority

You must be at least eighteen years old and legally able to enter a contract to use the services in your own name. If you use the services for an owner, a company or another person, you confirm that you have authority to act for that party and to share the information that the service needs.

If you are a tenant attending a signing, you confirm that the information you give at the table is accurate and that any identity document you present belongs to you. If you are an owner, you confirm that you have the right to lease the property and to authorise the desk to issue keys.

We may ask for reasonable proof of authority before we release a key, prepare a lease pack or share a unit file. If proof is not provided, we may postpone the service until the position is clear.

4. Scope of Services

The Company provides six core desk services: Lease Signing Desks, Key Tag Issue Runs, Move-Out Walk Sheets, Deposit Return Cycles, Storage Unit Rentals and Parking Stall Assignments. Each service is described in more detail on the services page, and that description forms part of these terms.

We also provide computer integrated systems design work for rental back offices. That work may include document naming rules, rent schedules, reminder letters, restricted file storage and simple reporting. Systems work is scoped in writing before it begins, and a scope note lists what is included and what is not.

We are not a law firm, a tax adviser or a licensed property manager in every jurisdiction. We prepare documents from templates and from owner instructions, and we do not provide legal advice about the rights of a tenant or an owner. If a matter needs legal advice, we will say so and recommend that the party consult a qualified professional.

5. Bookings and Scheduling

Desk appointments are made by phone at +17432393895 or by email to leasing@dkweston.lol. A booking is confirmed only when the desk replies with a date and a time. A message that describes a preference is an enquiry, not a confirmed slot.

Please arrive on time. If you are more than fifteen minutes late, the slot may be offered to another party and a new appointment will be arranged. If you need to move an appointment, tell the desk at least one business day ahead where possible, so that the table and the key rail can be prepared for someone else.

We may reschedule a desk appointment for reasons outside our control, including severe weather, a utility failure at the porch or an urgent matter at another property. If that happens, we will contact you with the earliest alternative and will not charge for the moved slot.

6. Fees and Payment

Fees for desk services are quoted in writing before a booking is confirmed. A quote states the service, the number of units or keys, the travel involved and any item that is charged separately. The quote remains valid for the period stated on it.

Unless a quote says otherwise, invoices are payable within fourteen days of the service date. Payment may be made by the method shown on the invoice. The desk does not accept cash at the porch without a prior arrangement, because cash handling complicates the record.

Late payment may lead to a pause in non urgent work and, where a written agreement allows it, to a reasonable late charge. We will always send a reminder before we pause a service, and we will never withhold a key or a signed document as a bargaining tool.

Government taxes and filing fees are charged where they apply. If a fee changes after a quote because the scope changes, we will explain the change and obtain approval before the extra work is done.

7. Key Tags and Key Handling

Every key issued by the Company receives a stamped tag and a hook rail position. The tag is part of the service, not a gift, and it remains the property of the Company. A tenant receives the key, the tag and a signed key receipt that records the unit, the date and the number of keys issued.

Keys must be returned at the end of a tenancy, at a time agreed with the desk. A key that is not returned may lead to a lock change, and the reasonable cost of that change may be charged to the responsible party where the lease allows it. The desk will always explain the cost before a lock is changed, except where an urgent security risk makes an immediate change necessary.

Lost keys must be reported promptly. The desk will check the rail, confirm the unit, prepare a replacement and record the event in the unit file. A replacement fee may apply, and it will be stated in the quote or in the lease schedule.

Keys must not be copied without the written permission of the owner. A copy that is made without permission may be treated as a breach of these terms and may end the desk service for that property.

8. Move-Out Walks and Deposit Cycles

A move-out walk is conducted with the tenant present whenever it is practical. The desk prepares a printed sheet, records the condition of each area, takes photographs in the same visit and asks the tenant to sign the sheet before leaving. The tenant receives a copy at the end of the walk.

The signed sheet is the shared reference for the deposit cycle. Deductions are itemised against a specific line on the sheet, priced with a reference note and explained in a plain covering letter. The desk does not add a deduction that is not supported by the sheet or by a later dated note that is shared with the tenant.

If a tenant disputes a line, the desk will reopen the file and respond in writing within a reasonable time. The owner receives both the dispute and the response so that a decision can be made with the full record in view.

The deposit cycle closes on the date set out in the lease or in the desk note given at signing. We aim to meet that date in every case and will contact both parties in advance if a legal or accounting step causes a delay.

9. Storage Units and Parking Stalls

Storage unit rentals are documented by a written agreement that lists the unit mark, the access window, the permitted contents and the notice terms. A unit tag is fitted at the door, and the access method is recorded in the unit file. Perishable, hazardous or illegal items must not be stored in a unit; if such items are found, the owner may require removal and may end the agreement.

Parking stalls are assigned from the stall board at the porch and written into the lease schedule. A stall is personal to the unit named in the schedule and must not be sublet without the written agreement of the owner. Visitor stalls are managed with a short guest log and are not a permanent assignment.

The Company may reassign a stall or a storage unit where a property needs change, where maintenance requires it or where a safety concern arises. A reassignment is recorded with the date, the reason and the people informed, and the affected party receives a written note.

10. Systems Design and Technical Work

Systems work is delivered against a written scope. The scope lists the outputs, the inputs that the owner will provide, the acceptance steps and the support period. A change to the scope is agreed in writing before the extra work begins.

The Company builds small, readable systems that are easy to hand over. We do not promise that a system will suit every future need, and we do not guarantee that a third party tool will remain available. Where a tool is essential, the scope will name it and will describe the fallback if it changes.

Owners are responsible for keeping their own credentials secure, for deciding who may access a document and for complying with the record keeping rules that apply to their business. The Company will explain the controls it has built, but it cannot guarantee the conduct of every person who is given access by an owner.

11. Owner and Tenant Responsibilities

An owner who engages the Company agrees to provide accurate property details, a lawful lease template where one is required, clear instructions for the service and timely approval for any decision that the desk cannot make alone. An owner also agrees to tell the desk promptly if a lease term, a contact detail or an access code changes.

A tenant agrees to provide accurate information at signing, to attend the move-out walk in person where practical, to return keys on time and to keep the unit in the condition required by the lease. A tenant also agrees to report a lost key without delay and to respect the access rules for a storage unit or parking stall.

Both parties agree to treat desk staff with courtesy. The desk will not continue a conversation that becomes threatening, and a safety concern at the porch may lead to an appointment being ended and the matter being reported.

12. Acceptable Use of the Website

You may read this website, print a page for your own reference and use the contact form to reach the desk. You must not attempt to gain unauthorised access to the site or its files, interfere with the normal operation of the site, introduce malicious code or use automated tools to copy the site at a volume that disrupts service.

You must not use the contact form to send unlawful, abusive, misleading or unsolicited commercial messages. Messages that contain threats or that impersonate another person may be reported, and the desk may refuse further contact through that channel.

We may suspend access to the website for maintenance or security reasons. The site is provided as a convenience, and a short outage does not affect a signed lease or a confirmed appointment.

13. Intellectual Property

The text, layout, styling, code and graphics on this website belong to DKWeston LLC or are used with permission. You may not copy the site for commercial use, republish its text as your own or remove a notice of ownership. A short quotation with a clear reference to this site is permitted for fair comment or review.

Documents that the Company prepares for an owner, such as a lease pack or a walk sheet, are provided for that owner to use for the named property. The underlying templates and working methods remain the property of the Company. An owner may not resell a template or distribute it as a product.

The brand name, the tag device and the desk styling are used by the Company in the ordinary course of business. Nothing in these terms grants a licence to use a name or mark in a way that suggests an endorsement.

14. Confidentiality and Records

The Company treats the contents of a unit file as confidential. Access is limited to desk staff, the developer who maintains the systems and the owner of the property. We do not discuss a tenant matter with a third party unless the tenant or the owner has asked us to, or unless the law requires it.

An owner who receives a document from us agrees to use it only for the property and the decision it was prepared for. An owner must not circulate a tenant document to a wider group without a lawful reason.

Records are kept for the periods described in our Privacy Policy. When a retention period ends, the record is deleted or the personal details are removed. A copy that is needed for an open dispute is kept until the dispute is closed.

15. Third Party Services

The website and the desk may rely on third party tools for hosting, email, document storage and payment. Those tools are provided by other organisations and are subject to their own terms and privacy notices. The Company is not responsible for an outage that is caused by a third party, but we will make reasonable efforts to keep a service running and to tell affected parties about a delay.

A link from this site to another site does not mean that we endorse that site. You use a third party service at your own risk and should read its terms before you enter personal details.

16. Disclaimers

The website and the services are provided with reasonable skill and care. Beyond that, the Company does not make a promise that a service will be uninterrupted, error free or suited to a particular purpose that was not described in the written scope.

The Company does not provide legal, tax or investment advice. A document that we prepare is based on the instructions and templates that an owner supplies. An owner is responsible for confirming that a document meets the requirements that apply to the property and the tenancy.

Condition notes and photographs record what a desk observer saw on the day of a walk. They are not a structural survey, a pest inspection or a guarantee that a hidden defect does not exist. A specialist inspection should be arranged where one is needed.

17. Limitation of Liability

To the fullest extent allowed by law, the Company is not liable for indirect, incidental, special or consequential loss, including lost rent, lost profit or loss of business opportunity, that arises from the use of the website or the services.

Where liability cannot be excluded, the total liability of the Company for a service is limited to the fee paid for that service in the three months before the event that gave rise to the claim. This limit does not apply to fraud, wilful misconduct or a liability that the law does not allow us to limit.

Nothing in these terms limits a right that a consumer has under a law that cannot be waived by agreement. If a clause is found to be unenforceable, the remaining clauses continue to apply.

18. Indemnity

You agree to indemnify DKWeston LLC against a reasonable loss, cost or claim that arises from your breach of these terms, from information that you supplied that was false or misleading, or from your unlawful use of a property, a key, a storage unit or a parking stall.

This indemnity does not apply to a loss that was caused by the negligence or wilful misconduct of the Company. If a claim is made, we will tell you promptly and will allow you to participate in the response where it is reasonable to do so.

19. Suspension and Termination

We may suspend or end a service if a payment remains overdue after a reminder, if an instruction would require us to act unlawfully, if a safety concern arises at the porch, or if a party repeatedly breaches these terms. Where the matter can be fixed, we will explain what is needed and allow a reasonable time to put it right.

You may end a service by written notice to leasing@dkweston.lol. A confirmed desk appointment may be cancelled without charge if notice is given at least one business day ahead. Work already completed remains payable, and documents already delivered remain with the party that received them.

Ending a service does not end the retention duties described in our Privacy Policy, and it does not remove a legal obligation that applies to a signed lease or a closed deposit cycle.

20. Disputes and Governing Law

If a concern arises, contact the desk first. Most matters are resolved by a short conversation and a review of the unit file. Send a written summary to leasing@dkweston.lol and allow a reasonable time for a reply before taking another step.

These terms are governed by the laws of the State of Utah and the applicable laws of the United States. A dispute that cannot be resolved by discussion may be brought before a court of competent jurisdiction in Utah County, Utah, unless a law that applies to a consumer requires a different forum.

Before a formal step is taken, both parties agree to consider a mediation or a neutral review of the file. The cost of a neutral review is shared unless the reviewer decides otherwise.

21. Changes to These Terms

We may update these terms when a service changes or when the law requires it. When a change is material, we will update the date at the top of this page and post a short note on the homepage. A change does not apply retrospectively to a service that was completed before the change took effect.

The current version is the version published here. If you need the version that applied when you booked a service, contact the desk and we will provide it from the records.
